Philips Respironics Halts Sales of Recalled CPAP Machines in U.S.
Philips has currently halted U.S. sales of its defective ventilators and CPAP machines since they recently agreed to a consent decree with the FDA and the Department of Justice. The company disclosed this news in a Securities and Exchange Commission filing. Under the agreement’s terms, Philips would continue servicing previously sold sleep apnea machines in the USA, but couldn’t sell new ones until it meets corrective actions laid out by the FDA.
In June 2021, nearly one million breathing machines manufactured by Philips were recalled from the market. The problem with the machines rests in the polyester-based foam that is used to reduce sound and vibrations the machines make when in use. Over time, the foam breaks down, sending tiny particles of foam and toxic chemicals into the airways of the person using the machine. This may lead to respiratory system issues and infections, asthma, cancer, and other serious health concerns.
Plaintiffs have filed lawsuits against Philips alleging that as they continued to use these machines, they breathed in deadly particles and gasses, which led to their health problems. Plaintiffs claim that Philips knew of the health risks associated with PE-PUR foam but did not warn consumers of the risks.
