Philips CPAP Users Continue to Experience Health Issues Almost 2 Years Post-Recall

When Philips recalled millions of its CPAP and BiPAP breathing devices due to defective foam in 2021, patients had to consult their physicians and make a grave decision to either continue to use the device and risk dangerous health problems, or discontinue use and still face risks associated with sleep apnea.

Now, almost two (2) years later, patients are still waiting on answers about whether their machine will be repaired or replaced. And while they wait, more injuries have surfaced. According to the FDA, which issued an update on certain recalled Philips CPAP, BiPAP, and mechanical ventilators, over 8,000 medical device reports were received by the federal safety regulator between November 1, 2022 and the end of the year. Of these reports, there were 82 reports of deaths.

The problem with the recalled machines lies within the devices themselves. Lined with a foam material to quiet vibrations when the machine is in use, the foam can degrade over time. This causes off-gassing of certain chemicals and particles which are then ingested by the patient and potentially lead to adverse health issues.

Thousands of former device users are seeking compensation from claims against Philips. They allege that Philips knew—or should have known—about the risks associated with the faulty foam and should have warned consumers. Some of the injuries plaintiffs have experienced include:
