Talcum Powder Litigation Proceeds as U.S. Justice Department Supports Plaintiffs
In a July 2022 brief, the U.S. Department of Justice sided with plaintiffs in the Johnson & Johnson bankruptcy filing appeal. Since February, J&J had been working toward a bankruptcy plan to manage the liability it faces to consumers concerning the ongoing talcum powder ovarian cancer litigation. J&J created a separate company, LTL Management, LLC, to manage this massive liability. Unfortunately, this may delay plaintiffs from getting justice for their injuries.
Approximately 38,000 lawsuits have been filed against J&J concerning its talcum powder products. Studies have shown that talcum powder usage in the genital area may increase a woman’s risk of developing ovarian cancer.
Ovarian cancer is often referred to as the “silent killer,” as its presenting symptoms are often mistaken for other minor conditions, such as gastrointestinal issues. These symptoms may develop after the cancer has reached an advanced stage or has metastasized. It is considered one of the deadliest cancers in women. The plaintiffs in the talcum powder lawsuits claim that J&J knew about the connection between its talcum powder products and ovarian cancer, yet neglected to warn consumers of this potentially deadly risk.
The U.S. Bankruptcy Judge overseeing the matter has continued the stay, or pause, for the thousands of talcum powder lawsuits pending while this bankruptcy process proceeds. However, U.S. Trustee Andrew Vara, on behalf of the Justice Department, notes that LTL’s Chapter 11 petition should be dismissed because the bankruptcy filing “fails the good faith test”.
