3M Earplug Trial Underway

As the first 3M Combat Arms military earplug trial continues in a Florida federal court, plaintiffs impacted by the defective product eagerly await a ruling. As many as 230,000 former service men and women have filed matters against 3M for manufacturing defective earplugs between 2003 and 2015 that allegedly caused hearing loss and other hearing related problems.

This is the first bellwether trial to take place in the litigation, and will be followed by two additional trials before different juries in May and June.

3M’s Combat Arms earplugs were designed to be dual-ended: if worn one way, the user could block out loud blasts during combat or training while still being able to hear commands, and if worn in reverse, the user would be able to block out all sound.  Plaintiffs allege, however, that that the shape of the earplug was defective and failed to provide adequate protection. Claimants who used these earplug have experienced hearing problems including tinnitus, and in some cases, permanent hearing loss.
